1. GENERAL PROVISIONS
1 The online shop: Patchwork, operating at: https://patchworkngo.org/sklep/, is operated by: Patchwork Association, based in/at: ul. Królowej Jadwigi 103/1, operating under NIP: 6783196949, REGON: 521517760.
(2) These Terms and Conditions of the Online Shop set out the rules for making purchases from the Online Shop: Patchwork and, in particular, the rules and procedure for concluding distance sales contracts through the Shop, as well as the procedure for complaints and the procedure for withdrawal from the contract by the Consumer.
(3) With regard to Services provided by electronic means, these Regulations are the Regulations referred to in Article 9 of the Act on Provision of Services by Electronic Means of 18 July 2002 (i.e. Journal of Laws of 2020, item 344, as amended).
(4) The Rules and Regulations are addressed to all Customers of the Store. All Customers are obliged to familiarise themselves with the provisions of the Rules and Regulations before making a purchase.
(5) Each Customer is obliged to comply with the provisions of the Terms and Conditions. Sales take place on the basis of the version of the Terms and Conditions in force at the time the order is placed.
(6) Each Customer has the opportunity to read the Terms and Conditions at any time by clicking on the hyperlink on the Store's website: https://patchworkngo.org/sklep/: "Shop Regulations". The Rules and Regulations can be downloaded and printed at any time.
(7) All information contained on the website of the Store: https://patchworkngo.org/sklep/, referring to products (including prices), does not constitute an offer within the meaning of Article 66 of the Act of 23 April 1964 Civil Code (i.e. Journal of Laws of 2023, item 1610, as amended), but an invitation to conclude a contract, pursuant to Article 71 of the Act of 23 April 1964 Civil Code (i.e. Journal of Laws of 2023, item 1610, as amended). The Customer, by sending the Order Form, makes an offer to purchase and deliver the indicated Goods for the price and on the conditions specified in the description.
2. DEFINITIONS
Rules and Regulations - this set of regulations organising the principles of use of Store Services by Customers.
Consumer - a natural person concluding an Agreement through the Shop, not directly related to his/her economic or professional activity.
Entrepreneur on the rights of a Consumer - a natural person concluding a Civil Law Contract through the Shop, directly related to his/her business, when the content of the Contract indicates that it is not of a professional nature for that person, arising in particular from the subject of his/her business activity, made available on the basis of the provisions of the Central Register and Information on Business Activity. For the purposes of these Terms and Conditions, it is assumed that in the absence of a distinction between the two groups of entities indicated, the Terms and Conditions shall apply to both Consumers and Entrepreneurs on the rights of Consumers.
Customer - a natural person (including a Consumer) who is at least 13 years of age (provided that he or she has obtained the consent of the legal representative), a legal person and an organisational unit that is not a legal person and to which special regulations grant legal capacity, who uses the Services provided by the Shop.
Order Form - a service available on the website of the Store, by means of which the Customer may make a purchase, in particular by adding Goods to the Basket and specifying certain terms and conditions of the Sales Agreement, among others the method of delivery and payment.
Basket - an element of the Shop where the Goods selected by the Customer are visible and where the Customer has the possibility of determining and modifying the Order data, including the quantity of the purchased Products.
Shop - the website belonging to the Seller, available under the domain: https://patchworkngo.org/sklep/, through which the Customer may purchase Goods from the Seller.
Seller - Patchwork Association, with registered office at/at: ul. Królowej Jadwigi 103/1, entered in the register of entrepreneurs kept by the Court of the 11th ECONOMIC DEPARTMENT OF THE NATIONAL REGISTER in: Krakow, Commercial Division, under KRS no.: 0001058285, NIP no.: 6783196949, who, in the course of his commercial or professional activity, offers sales via his website.
Goods - a movable item traded between the Shop and the Customer, the conditions of sale of which are set out in the Order Form.
Goods with digital elements - goods containing or connected to digital content or a digital service in such a way that the absence of the digital content or service would prevent it from functioning properly.
Product - any good or service, including real estate, digital services and digital content, as well as rights and obligations.
Digital environment - the computer hardware, software and network connections used by the Consumer to access or use digital content or a digital service.
Integration - combining digital content or digital service with elements of the Consumer's digital environment and integrating it into those elements to ensure compliance with the Digital Content or Digital Service Agreement.
Compatibility - the interoperability of digital content, digital service, or merchandise with hardware or software that is typically used to use digital content, digital service, or merchandise of the same type, without the need to transform them.
Functionality - the ability of a digital content, digital service or commodity to perform its function given its intended use.
Interoperability - the ability of digital content, a digital service or a good to interact with computer hardware or software other than those normally used for digital content, a digital service or a good of the same type.
Online shopping platform - a service using software, including a website, a part of a website or an application, operated by or on behalf of a trader, which enables consumers to conclude distance contracts with other traders or natural persons who are not traders to conclude distance contracts with other natural persons who are not traders.
Provider of an online trading platform - a trader who operates an online trading platform, provides an online trading platform to entities or enables the use of that platform.
Contract - a contract for the sale of Goods at a distance, concluded by the Customer via the Shop, usually via the Order Form.
3. RECEIVING AND PROCESSING ORDERS
(1) A prerequisite for using the Store is reading and accepting these Terms and Conditions. By placing an order, the Customer accepts the content of the Terms and Conditions.
(2) The main parameters determining the placement of the offers presented to the consumer as a result of the search, which are also presented in direct connection with the respective offer, in a visible manner, are as follows:
The shop uses various criteria to rank search results, e.g. search history, product popularity.
(3) The shop marks sponsored offers and paid advertisements. This information is presented in direct relation to a given search result, in a visible way that stands out from the overall interface.
(4) The price stated in the order is the total value the Customer is obliged to pay, including applicable tax (gross price). The cost of delivery is not included in the price, as it depends on the delivery method chosen by the Customer for the Product.
(5) If the Consumer is required to pay more than the agreed price described in the previous paragraph, the Shop shall immediately inform the Consumer of this fact, explaining the reason for the price difference. Charging the Consumer with additional costs shall only take place after obtaining the Consumer's express consent.
(6) The Seller reserves the right to change prices, located in the Store, to introduce new Products for sale, to carry out and cancel promotional actions, or to introduce changes in them, in accordance with applicable law.
(7) When a promotion is introduced, the Store informs customers of the lowest price for the Product over the last 30 days. If the Product has been on sale for less than 30 days, the price before the promotion is the lowest price since the Product was introduced to the Store. This information is shown next to the promotional price of the Product.
8 Orders from Customers are accepted by means of a sent Order Form, made via the website: https://patchworkngo.org/sklep/ or by e-mail to: office@patchworkngo.org, 7 days a week, 24 hours a day.
The order of a Product is completed by selecting the Goods in which the Customer is interested, clicking on the "ADD TO CART" button next to the Product description, and then, from the "CART" level, located in the Shop tab, completing the Order Form, including the choice of delivery and payment method or the choice of payment on delivery, if available for the selected Product, and then clicking on the purchase confirmation.
(10) Entrepreneurs on the rights of Consumers should indicate, already at the time of ordering the Products, that the purchase is not of a professional nature for them.
(11) Once an order has been placed, the Customer receives a confirmation of the order placed to his/her e-mail address as specified in the Order Form.
(12) Once the Customer has received confirmation of acceptance of the offer, the Seller's order fulfilment process begins, whereby:
a) in the case of an order paid on delivery, it starts at the latest on the next working day after its confirmation by the Seller.
b) in the case of an order paid by traditional bank transfer - it begins after the payment for the placed order is credited to the Store's bank account.
(13) Orders placed in the Shop are processed during the Shop's working hours (on working days, Monday to Friday, from: 9:00, to: 5:00 p.m. Orders placed on working days after 5:00 p.m., on Saturdays, Sundays or holidays, will be processed on the next working day.
(14) The Customer will receive a message about acceptance of the order for fulfilment, which is understood to be the Seller's statement of acceptance of the offer. As soon as it is received by the Customer, the Contract of Sale is concluded.
(15) A VAT receipt is issued for each order. Upon the Customer's request, a VAT invoice will also be issued and sent to the Customer (Article 106b(3) of the Value Added Tax Act of 11 March 2004, i.e. Journal of Laws 2023, item 1570, as amended).

(17) The Seller does not verify the authenticity of Customers' reviews of Products purchased in the Store.
4. DELIVERY AND TRANSPORT COSTS
1. the fulfilment of the dispatch of the order in the Store is carried out through:

(2) Orders placed in the Store are processed only on working days. Orders placed on Saturdays, Sundays and holidays will be fulfilled on the nearest working day.
The usual waiting time for delivery is: 5 working days. The waiting time consists of the processing time of the order, i.e. the completion of the Products for the order and the expected delivery time, which is from 24 hours, in the case of Poland.
(4) The seller is not responsible for delays caused by the carrier.
(5) When receiving the parcel delivered by courier, the Customer should in his presence carefully check the content and completeness of the parcel, the condition of the outer packaging and the condition of the ordered Product. In the event of damage to the parcel, the Customer should draw up a damage protocol with the courier, in two identical copies signed by the Customer and the courier.
(6) It is possible to collect the ordered Product in person at the Stationary Store, at: ul. Królowej Jadwigi 103/1.
5. PAYMENT PROCESSING
(1) The following payment methods are possible within the operation of the Shop:
1) cash on delivery - upon collection of the consignment;
2) by bank transfer;
3) PayU
(2) The specific terms and conditions for making payments via banks or other available services are set out in the relevant banks' and services' terms and conditions.
(3) The Customer who has chosen the option of payment by bank transfer is obliged to pay for the order within five (5) working days from the date of placing the order. Otherwise, the Seller's offer is not binding and the order is removed from the system. In the title of the payment, it is sufficient to indicate only the number of the order being placed. There is a possibility of extending the payment period, with prior notification to the Shop staff: office@patchworkngo.org (e-mail), +48 12 687 44 26 (tel), ________ (address).
6 ADVERTISEMENT
(1) The Seller shall be liable for non-compliance of the Product with the Contract. The provisions of the Civil Code Act of 23 April 1964 (i.e. Journal of Laws of 2023, item 1610, as amended) concerning warranty for defects shall not apply to contracts obliging to transfer the ownership of the Goods to the Consumer, including in particular sale contracts, delivery contracts and contracts for work constituting the Goods.
(2) The Seller shall be liable for the lack of conformity of the Product with the Contract which exists at the time of its delivery and is disclosed within two (2) years from that time, unless the expiry date of the Product, as determined by the Seller, its legal predecessors or persons acting on their behalf, is longer. Any lack of conformity of the Product with the Contract which becomes apparent before the expiry of two (2) years from the time of delivery of the Product shall be presumed to have existed at the time of delivery unless the contrary is proved or the presumption cannot be reconciled with the specific nature of the Product or the nature of the lack of conformity of the Product with the Contract.
(3) If the Product is not in conformity with the Contract, the Consumer may request repair or replacement. The Seller may make a replacement when the Consumer demands a repair, or the Seller may make a repair when the Consumer demands a replacement, if bringing the Product into conformity with the Contract, in a manner chosen by the Consumer, is impossible or would require excessive costs for the Seller. If repair and replacement are impossible or would require excessive costs for the Seller, the Seller may refuse to bring the Product into conformity with the Contract.
(4) The Seller shall carry out repair or replacement within a reasonable time from the moment the Consumer has informed the Seller of the lack of conformity with the Contract and without undue inconvenience for the Consumer, taking into account the specific nature of the Product and the purpose for which the Consumer purchased it. The costs of repair or replacement, including in particular the costs of postage, carriage, labour and materials shall be borne by the Seller. For this purpose the Consumer shall make the Product subject to repair or replacement available to the Seller. The Seller shall collect the Product from the Consumer at his own expense. If the Product was assembled before the Product became incompatible with the Contract, the Seller shall disassemble the Product and reassemble it, after repair or replacement, or have it repaired or replaced at his own expense.
(5) If the Product is not in conformity with the Contract, the Consumer may make a declaration to reduce the price or withdraw from the Contract when:
a) The Seller has refused to bring the Product into conformity with the Contract;
b) The Seller has failed to bring the Product into conformity with the Contract;
c) the lack of conformity of the Product with the Contract continues despite the fact that the Seller has tried to bring the Product into conformity with the Contract;
d) the lack of conformity of the Product with the Contract is such as to justify either a reduction in price or withdrawal from the Contract, without prior request for repair or replacement;
e) it is evident from the Seller's statement or circumstances that he will not bring the Product into conformity with the Contract within a reasonable time or without undue inconvenience for the Consumer.
(6) The reduced price must be in such proportion to the price under the Contract as the value of the non-conforming Product remains to the value of the conforming Product. The Seller shall reimburse the Consumer the amounts due as a result of exercising the right to reduce the price, immediately, but no later than within fourteen (14) days, from the date of receipt of the Consumer's statement on price reduction.
(7) The consumer may not withdraw from the Contract if the lack of conformity of the Product with the Contract is insignificant. The lack of conformity of the Product with the Contract shall be presumed to be material.
(8) In the event of withdrawal from the Contract, the Consumer shall immediately return the Product to the Seller at the Seller's expense. The Seller shall reimburse the price to the Consumer immediately, no later than within fourteen (14) days of receipt of the Product or proof of its return, using the same method of payment used by the Consumer, unless the Consumer has expressly agreed to a different method of reimbursement that does not involve any costs for the Consumer.
9 Complaints about Products, can be made:
a) in writing to the Seller's registered office at ul. Królowej Jadwigi 103/1;
(b) by e-mail, to: office@patchworkngo.org.
10. The complaint should include:
a) details of the person making the complaint (name, postal address, e-mail address and contact telephone number);
(b) an indication of the reason for the complaint and the content of the request;
(c) the Order number as shown in the acknowledgement of receipt of the Order;
(d) the original or a copy of the proof of purchase (e.g. receipt or invoice) may facilitate the lodging of a complaint, but is not necessary for making a complaint.
11. The above provisions do not exclude the possibility of the Seller to provide a guarantee for the purchased Products, which is provided for in separate guarantee regulations.
7. RIGHT OF WITHDRAWAL
(1) Pursuant to the Act of 30 May 2014 on Consumer Rights (i.e. Journal of Laws of 2020, item 287, as amended), the Consumer may withdraw from the Agreement relating to the Products, purchased from the Shop, without giving any reason, by making a relevant statement in writing, within fourteen (14) days, counting from the date of delivery of the Goods (i.e. from the date of receipt of the Goods by the Consumer). This period is deemed to have been observed if the Consumer sends the declaration, before its expiry.
(2) The Consumer may withdraw from the Contract by submitting a statement of withdrawal from the Contract to the Seller. A model declaration is enclosed as Attachment No. 1 to these Terms and Conditions.
(3) The declaration of withdrawal from the Agreement should be sent to the address: ul. Królowej Jadwigi 103/1.
(4) The Consumer shall return the Goods to the Seller within fourteen (14) days from the date of withdrawal from the Contract. It is sufficient to send back the Goods before the deadline.
(5) The consumer shall only bear the direct costs of returning the Goods.
The Goods should be returned to the Seller's address: ul. Królowej Jadwigi 103/1, 30-209 Kraków.
(7) The Seller shall, within fourteen (14) days, from the date of receipt of the declaration of withdrawal from the Contract, reimburse to the Consumer all payments made by the Consumer, including the cost of delivery of the Goods, but the reimbursement of payments shall not take place until the Goods have been received back or the Consumer has provided proof of their return.
(8) If the Consumer has chosen a method of delivery of the Goods other than the cheapest method of delivery offered by the Seller, the Seller shall not be obliged to reimburse the Consumer for any additional costs incurred by the Consumer.
(9) The Seller shall refund the payment using the same means of payment used by the Consumer.
(10) The consumer shall be liable for any diminution in the value of the Product resulting from the use of the Product beyond what is necessary to establish the nature, characteristics and functioning of the Product.
(11) The right of withdrawal from the Sales Contract shall not apply to the Consumer in respect of the Contract:
(a) where the object of the performance is a non-refabricated good made to the Consumer's specifications or intended to meet the Consumer's personalised needs;
b) where the object of the performance is Goods which are perishable or have a short shelf life;
c) where the subject of the performance is alcoholic beverages, the price of which has been agreed upon at the conclusion of the Contract, the delivery of which can only take place after 30 days and the value of which depends on fluctuations in the market over which the Seller has no control;
d) where the object of the performance is Goods supplied in sealed packaging which cannot be returned after opening for health or hygiene reasons, if the packaging has been opened after delivery;
e) in which the subject matter of the performance is Goods which, after delivery, by their nature become inseparable from other goods;
(f) in which the subject matter of the performance is sound or visual recordings or computer programs, delivered in sealed packaging, if the packaging has been opened after delivery;
(g) for the supply of newspapers, periodicals or magazines, with the exception of a subscription contract;
h) in which the price or remuneration is dependent on fluctuations in the financial market over which the Seller has no control and which may occur before the end of the withdrawal period;
(i) for the supply of goods with digital elements, digital services or digital content not supplied on a tangible medium for which the consumer is liable to pay the price, if the Seller has commenced performance with the express and prior consent of the consumer, who has been informed prior to the commencement of performance that, following the Seller's performance, he will lose his right of withdrawal, and has acknowledged this and the Seller has provided him with confirmation;
(j) concluded by public auction;
(k) for the provision of accommodation, other than for residential purposes, carriage of goods, car rental, catering, leisure, entertainment, sporting or cultural events, if the contract specifies the date or period of the service;
(l) where the Consumer has expressly requested that the Seller come to him to carry out urgent repair or maintenance; if the Seller provides additional services other than those which the Consumer has requested to be performed, or goods other than replacement parts which are necessary for the performance of the repair or maintenance, the right of withdrawal shall apply to the Consumer in respect of the additional Services or Goods;
(m) for the provision of services for which the Consumer is liable to pay the price, where the Consumer has expressly requested the Seller to come to the Seller for repair and the service has already been provided in full with the Consumer's express and prior consent.
12 The right of withdrawal from a Contract concluded at a distance shall be granted to Consumers and Entrepreneurs on the rights of Consumers.
8. OUT-OF-COURT DISPUTE RESOLUTION
(1) In the event that the complaint procedure fails to produce the result expected by the Consumer, the Consumer may avail himself of, inter alia:
Mediation is conducted by the locally competent Provincial Trade Inspection Inspectorate, to which a request for mediation should be submitted. As a rule, the proceedings are free of charge. The list of Inspectorates can be found at: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
The assistance of the locally competent permanent amicable consumer court, operating at the Provincial Inspectorate of Trade Inspection, to which a request for consideration of the case before the amicable court should be submitted. Free assistance from the municipal or district consumer ombudsman.

(2) This chapter entitled "Out-of-court dispute resolution" does not apply to Entrepreneurs on the rights of Consumers.
9. PROTECTION OF PERSONAL DATA
(1) The Customer, by placing an order, agrees to the processing, provided by him/her, of his/her personal data, for the purpose of processing and servicing the order, by the Seller, who is also the administrator of the personal data, within the meaning of Article 7 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), Official Journal of the EU L 119, 4 May 2016, pp. 1-88.
(2) The administrator of the personal data provided by the Customer while using the Shop is the Seller.
(3) Personal data contained in the Vendor's database shall not be transferred to entities that are not involved in the performance of the Contract.
(4) The Customer, in accordance with Article 15 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), Official Journal of the EU L 119, 4 May 2016, pp. 1-88, has the right to access his/her personal data and may request its correction or deletion. The Vendor shall ensure that each Customer has the right to control the processed personal data.
5 The provision of personal data is voluntary, however, the lack of consent for the processing of personal data prevents the fulfilment of the Customer's order.
6 Detailed information on personal data and privacy protection is provided in the "Privacy Policy" section of the Shop website.
10. FINAL PROVISIONS
(1) The Rules and Regulations set out the principles for the conclusion and performance of a Sales Contract for the Products found on the Shop website.
2 The sales contract is concluded between the Customer and the Seller.
(3) The Rules and Regulations are available to all Customers electronically on the Shop's website: https://patchworkngo.org/sklep/, under the tab: "Shop Regulations".
(4) In order to use the Store's Services, it is necessary to have equipment which allows access to the Internet and a web browser capable of displaying web pages, as well as to provide an e-mail address for the transmission of information concerning order completion.
(5) It is forbidden for any person, including customers, to post unlawful content on the Store's website.
(6) In matters not covered by these Regulations, the relevant provisions of generally applicable law shall apply.
(7) These Terms and Conditions do not exclude or limit any of the rights of the Customer, who is a Consumer, to which he is entitled under mandatory provisions of law. In the event of any conflict between the provisions of the Terms and Conditions and mandatory provisions of law granting rights to consumers, the provisions of law shall prevail.
(8) Provisions of the Terms and Conditions that are less favourable to the Consumer than the provisions of the Act of 30 May 2014 on Consumer Rights (i.e. Journal of Laws of 2020, item 287, as amended) shall be invalid and the provisions of the Act shall apply in their place.
(9) Should any provision of these Terms and Conditions be or become invalid or ineffective, the validity of the entire Terms and Conditions for the remainder shall not be affected. In such a case, the Parties shall replace the invalid or ineffective provision with another provision that reflects the intended economic purpose as closely as possible. Accordingly, this shall also apply to any gaps in the Terms and Conditions.

WITHDRAWAL FORM FOR A CONSUMER OR A TRADER WITH CONSUMER RIGHTS
Hereby, acting pursuant to Article 27 of the Consumer Rights Act of 30 May 2014 (i.e. Journal of Laws of 2020, item 287, as amended), as amended:
Article 27 of the Consumer Rights Act
A consumer who has concluded a distance or off-premises contract may, within 14 days, withdraw from that contract without giving any reason and without bearing the costs, except for the costs referred to in Articles 33, 34(2) and 35.

Citation:
The Consumer, as well as the Entrepreneur on the rights of the Consumer, has the right to withdraw from the Contract within 14 days, without giving any reason, and in the case of a Contract concluded during an unarranged visit to the Consumer's residence or usual residence or excursion, within 30 days. The period of withdrawal shall expire after 14 days from the date of conclusion of the Agreement or on which the Consumer has taken possession of the thing/thing or part thereof or on which a third party, other than the carrier and indicated by the Consumer, has taken possession of the thing/thing or part thereof and, in the case of an Agreement concluded during an unscheduled visit to the Consumer's residence or usual place of stay or excursion, after 30 days from the date of taking possession of the thing/thing.
In order to exercise the right of withdrawal, the Consumer must inform the Seller, i.e. Patchwork, at: ul. Królowej Jadwigi 103/1, 30-209 Kraków, at e-mail address: office@patchworkngo.org, of his/her decision to withdraw from the Agreement by an unequivocal statement sent by post or e-mail. The consumer may use the model withdrawal form attached to these Regulations, which is not obligatory. The deadline shall be deemed to have been met if the Consumer has sent information concerning the exercise of his/her right of withdrawal from the Agreement before the expiry of the deadline for withdrawal from the Agreement. The Consumer should send back or hand over the Product to the Seller, to the address: ul. Królowej Jadwigi 103/1, 30-209 Kraków, immediately and in any case not later than 14 days from the day on which he informed the Seller of his withdrawal from the Agreement. The deadline shall be deemed to have been met if the Consumer returned the Product to the Seller before the expiry of the 14-day period.
In the event of withdrawal from the Contract, the Seller shall reimburse to the Consumer all payments received from the Consumer, including the costs of delivery of the Product (except for the additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest and usual method of delivery offered by the Seller), immediately and in any event not later than 14 days from the day on which the Seller was informed of the Consumer's wish to exercise the right of withdrawal from the Contract. The Seller may withhold reimbursement of the payment until it has received the Product or until the Consumer has provided evidence of its return, whichever event occurs first. The Seller will refund the payment using the same method of payment that was used by the Consumer in the original transaction, unless the Consumer has expressly agreed otherwise - in any case the Consumer will not incur any fees in connection with this refund.
